# Terms and Conditions
These terms and conditions (the Terms and Conditions) govern the use of YosemiteWest.org (the Site). The Site is owned and operated by the Board of Directors on behalf of the Yosemite West Property and Homeowners, Inc. (the Association or YWPHI).
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
## Intellectual Property
All content published and made visible on this Site remains the property of the person or persons previously claiming ownership. The webmaster and the Board of Directors of the Association (the Operators) do not claim ownership of or rights to any posted material by virtue of its posting.
## Acceptable Use
As a user of the Site, you agree to use the Site in keeping with any and all laws applicable in the Site's operating jurisdiction, and not to:
- Harass or mistreat other users of the Site;
- Violate the rights of other users of the Site;
- Violate the intellectual property rights of the Site owners or any third party to the Site;
- Access the account of another user or any unauthorized part of the Site without permission;
- Act in any way that could be considered fraudulent;
- Post any material that may be deemed inappropriate or offensive.
If the Operators believe you are using the Site illegally or in any manner that violates these Terms and Conditions, the Operators reserve the right to limit, suspend or terminate your access to the Site. The Operators also reserve the right to take any legal steps necessary to prevent you from accessing the Site and pursue any legal remedies for harm done as a result of any user's actions.
## User Contributions
Users may post the following on the Site:
- Photos
- Videos
- Information, personal opinions, comments, and responses visible to the Site’s users and potentially the public
- Documents and files with content appropriate to the Site's users
By posting publicly on the Site, you agree not to act illegally or violate these Terms and Conditions.
## Accounts
When you create an account on the Site or sign in and use an account, you agree to the following:
- You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
- All personal information you provide to the Operators through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
The Operators reserve the right to suspend or terminate your account if you are using the Site illegally or if you violate these Terms and Conditions.
## Commercial Activity
The Site is intended for use by members of the Yosemite West Property and Homeowners, Inc., a not-for-profit corporation registered in the state of California.
The site is limited to non-commerical activity. The Operators reserve the right to remove any post or content that appears intended to promote commercial activity or profit without express approval of the Association.
## Limitation of Liability
The Operators, the Association, its directors, officers and agents will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
## Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless the Site's Operators, the Association, its directors, officers and agents from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of the Site or your violation of these Terms and Conditions.
## Applicable Law
These Terms and Conditions are governed by the laws of the State of California.
## Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, these provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid and in effect.
## Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law, to reflect any changes in the way the Site operates and in the way the Operators expect users to behave on the Site. The Operators will notify users by email of changes to these Terms and Conditions or post a notice on the Site.
